Moonjai LLC - Terms of Service

Welcome to Moonjai!

These Terms of Service ("Terms") govern your access to and use of the Moonjai mobile application, its website (https://www.moonjai.com/), and all related services (collectively, the "Services") provided by Moonjai LLC ("Moonjai," "we," "us," or "our").

By creating an account or by accessing or using our Services, you agree to be bound by these Terms and our Privacy Policy.

1. User Eligibility and Consent

You must be at least 13 years old to use the Services.

If you are under the age of 18 (a "Minor"), you represent and warrant that you have obtained permission from your parent or legal guardian to use the Services and that they have read, understood, and agreed to these Terms on your behalf.

2. Our Services

Moonjai provides a platform for Tanzanian O-level and A-level students to access educational resources. These resources include past examinations, solutions, notes, quizzes, AI-powered question solvers ("Private Solving"), and community-sourced answers ("Global Answers").

The features and content of the Services may change over time. We reserve the right to modify, suspend, or discontinue any part of the Services at any time, with or without notice.

3. User Accounts

  • Account Creation: You are responsible for providing accurate and current information when creating an account.

  • Account Security: You are responsible for safeguarding your account and for all activities that occur under it. Notify us immediately of any unauthorized use.

  • Termination: You may terminate your account at any time. We reserve the right to issue a warning, suspend, or terminate your account at our sole discretion, without notice, for any violation of these Terms.

4. Acceptable Use and User Conduct

You agree not to use the Services to:

  • Post or share any content that is unlawful, harmful, defamatory, obscene, harassing, or otherwise objectionable.

  • Share any personal information about yourself or others in public areas of the app, such as in "Global Answers."

  • Post content in "Global Answers" that is not relevant to the specific question or topic.

  • Engage in any form of academic dishonesty. The content provided is for study and reference purposes only.

  • Infringe upon the intellectual property rights of Moonjai or any third party.

  • Attempt to reverse-engineer, decompile, or misuse the Services.

We reserve the right to remove any content and to investigate and take appropriate action against anyone who violates this provision, including warning, suspending, or banning the user.

5. Freemium Model, Subscriptions, and Payments

  • Free and Premium Services: Moonjai may offer both free and paid ("Premium") Services. We may, at our sole discretion, determine which features require payment. These may include, but are not limited to, access to advanced AI models or packages of usage credits.

  • Payments: If you purchase any Premium Services, either through a recurring subscription or a one-time purchase, you agree to our pricing and payment terms.

  • Billing: We may use a third-party payment processor to bill you. The processing of payments will be subject to the terms, conditions, and privacy policies of the payment processor in addition to this Agreement.

  • Refunds: All purchases are final and non-refundable, except where required by applicable law.

6. Intellectual Property Rights

  • Our Content: All rights, title, and interest in and to the Services—including the software, text, graphics, logos, and any content created by Moonjai such as notes, solutions, and AI-generated answers ("Moonjai Content")—are and will remain the exclusive property of Moonjai LLC and its licensors.

  • User Content: You retain ownership of the content you submit, such as your contributions to "Global Answers" ("User Content"). By posting User Content, you grant Moonjai a non-exclusive, worldwide, royalty-free, perpetual license to use, host, reproduce, and display it in connection with the Services.

  • Third-Party Content: The Services may contain third-party materials, such as national NECTA and regional mock examination papers. Moonjai does not claim ownership of such materials and provides access to them for educational, commentary, and informational purposes only. Your use of these materials is at your own risk.

7. Disclaimers and Limitation of Liability

  • "As Is" Service: The Services are provided on an "AS IS" and "AS AVAILABLE" basis without any warranties, express or implied.

  • AI Content Disclaimer: The answers and solutions generated by our AI features are for educational guidance only. They are generated by an automated system and may contain inaccuracies, biases, or errors. Moonjai is not responsible for any reliance you place on such information or for any academic or other consequences that result from its use. Always verify critical information with authoritative sources.

  • Limitation of Liability: To the maximum extent permitted by law, Moonjai shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Services.

8. Indemnification

You agree to defend and indemnify Moonjai LLC from any claims, liabilities, or expenses arising from your use of the Services or your violation of these Terms.

9. Dispute Resolution, Governing Law, and Arbitration

  • Governing Law: These Terms shall be governed by the laws of the State of Washington, United States, without regard to its conflict of law provisions.

  • Binding Arbitration: You and Moonjai agree to resolve any claims relating to these Terms or the Services through final and binding arbitration, except as set forth below. The arbitration will be administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules. The arbitration will be conducted in English, and may be held via teleconference or video conference.

  • Waiver of Class Actions: You agree to resolve disputes with Moonjai on an individual basis only. You may not bring a claim as a plaintiff or a class member in a class, consolidated, or representative action.

  • Exceptions to Arbitration: You may opt out of this agreement to arbitrate. To opt out, you must notify us in writing within 30 days of the date that you first become subject to this arbitration provision.

10. Changes to These Terms

We reserve the right to modify these Terms at any time. If a revision is material, we will provide at least 30 days' notice, for instance, through an in-app notification. By continuing to use the Services after revisions become effective, you agree to be bound by the revised terms.
